Petitioner is in jail custody since 19.08.2015 in a case registered for the offences punishable under Sections 379/411/ 120B/34 of the Indian Penal Code.

Petitioner is said to have been caught when he tried to run with the bag of the informant.

Contention on behalf of the petitioner is that petitioner happens to be a labourer and as a matter of fact, some dispute arose between petitioner and informant on the point of making payment of wages. But, informant in connivance with his supporters lodged this false case.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that the petitioner does not have any
