====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-08-2022 Heard Mr. Lallu Prasad, learned counsel for the petitioner and Ms. Veena Rani Prasad, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Special Case No. 19 of 2020 arising out of Masaurhi P.S. Case No. 37 of 2020 registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 13.12.2021 passed in Cr. Misc. 31401 of 2021. Earlier while rejecting the bail application, this Court has taken into consideration the fact that a huge commercial quantity of Ganja weighing 106 Kilograms has been recovered

Patna High Court CR. MISC. No.37458 of 2022(2) dt.10-08-2022 2/2 from the house of the petitioner and there is a reasonable ground to believe the commission of offence by the petitioner. Learned counsel for the petitioner has moved this application even before lapse of one year from the date of last rejection of the bail application and tried to re-argue the matter on merit and submits that Ganja has been recovered from joint house of the petitioner. The subsequent development which learned counsel tried to submit is that after framing of charge on 29.09.2021, the trial has not progressed.

Having heard learned counsel for the petitioner and taking into consideration the fact that a huge commercial quantity of Ganja has been recovered and the trial has already commenced, I am not inclined to grant regular bail to the petitioner.

Accordingly, the prayer for grant of regular bail of the petitioner stands rejected.
