JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 29.09.2015 in a case registered for the offences punishable under Sections 20B, 22, 23 and 24 of the NDPS Act.

From Indal Das 12 Kg Ganja and from Chhote Lal Thakur, 15 Kg. Ganja were recovered. The petitioner was not named in the FIR, his name sprang up on the confession of apprehended co-accused.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and only on confession of apprehended co-accused, the petitioner has been apprehended. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
