JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 10.12.2018 passed in Cr.Misc.No.71551 of 2018 and there is allegation of recovery of one single barrel rifle of 3.15 bore, country-made pistol of 12 bore, country-made pistol and one country-made sixer along with two cartridges of .315 bore.

Submission of learned counsel for the petitioner is that he is in custody for about one year and there is no substantial progress in the trial.

Heard learned APP and from perusal of the report it appears that case is pending for want of prosecution sanction. In view of above facts and circumstances, at this stage, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to conclude the trial as early as

Patna High Court CR. MISC. No.33963 of 2019(3) dt.24-07-2019 2/2 possible, preferably within a period of six months, otherwise petitioner is at liberty to renew his prayer for bail before the court below itself, which shall be considered on the basis of the materials available on the record.
