JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 05-092015 on the accusation that one kg 200 gm Ganja was recovered from his conscious possession.

The contention on behalf of the petitioner is that the alleged recovery is much less than commercial quantity and petitioner does not have any criminal antecedent. No doubt, the recovered Ganja is more than small quantity but admittedly, less than commercial quantity. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection
