The petitioners have preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, unknown accused persons are said to have fired resulting in the death of the wife of the informant on the spot.

It is submitted by learned counsel for the petitioners that from perusal of the FIR it would transpire that the alleged assailant had their faces covered. The informant has raised unfounded suspicion against seven accused persons including

Patna High Court CR. MISC. No.48918 of 2021(3) dt.10-03-2022 2/2 the petitioners herein. Out of them co-accused Chaitu Paswan has been enlarged on bail vide order dated 23.11.2017 passed in Cr. Misc. no. 47551 of 2017. The petitioners are in custody since 24.2.2021 and have no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the materials on record including grant of bail to the FIR named co-accused Chaitu Paswan and the petitioners having remained in custody for over 1 year, the petitioners are directed to be enlarged on bail in connection with Budha Colony P.S. Case no. 169 of 2017 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Patna.
