The petitioner apprehends his arrest in connection with Kateya P.S. Case No. 114 of 2021, registered for the offences punishable under Sections 304/34 of the Indian Penal Code. As per allegation, the petitioner encircled his maize field by wire flowing electric current after pilfering it from transformer. The father of the informant came into contact thereof and died. As per allegation, the act of the petitioner was intentional only to kill the father of the informant.

Learned counsel for the petitioner has submitted that the entire allegation is false. Nothing incriminating was recovered from the place of occurrence as described in paragraph No. 13 of the case diary. He has submitted further that the independent witnesses in

Patna High Court CR. MISC. No.47072 of 2021(4) dt.11-10-2022 2/2 paragraph Nos. 27 and 28 have stated that the electric wire was lying in the way and the informant died as he came into contact of that fallen wire.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 114 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. The petitioner shall appear before the court below on each and every date till framing of the charges.
