The petitioner seeks bail in connection with Kochadhaman P.S. Case No.109 of 2015 registered under Sections 302 and 201/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that on the basis of the recovery of dead body of an unknown female, the present case was lodged against unknown by the police. In course of investigation, the dead body was identified as that of Salma Khatoon by her mother, who raised suspicion against Majauri Khatoon, second wife of her husband, her daughter, Shahim and her husband, Md. Salam, in committing the
Patna High Court Cr.Misc. No.53191 of 2015 (3) dt.10-02-2016 2/2 murder of her daughter. Later on, police got recorded the confessional statement of Md. Salam, who disclosed about the complicity of the petitioner in the commission of the alleged offence. Except the confessional statement of Md. Salam, there is nothing against the petitioner to show his involvement in the present case. The petitioner having no criminal antecedent is in custody since 03.08.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman P.S. Case No.109 of 2015.
