The petitioner apprehends her arrest in connection with Masaurhi P.S. Case No. 258 of 2015 instituted for the offences under Sections 420,504 and 506 of the Indian Penal Code.

The prosecution case, in brief, is that the informant, Guriya Kumari gave a written petition before the Superintendent of Police, Patna alleging therein that her Gotini, the petitioner has transferred the land in her name by making forge signature of informant's husband through registered deed of sale dated 8.7.2011 and the informant made protest on which her Gotini, the petitioner and her husband Binu Lal assaulted her and

Patna High Court Cr.Misc. No.8027 of 2016 (3) dt.28-03-2016 2/2 threatened to kill her.

It is submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in this case due to family dispute. The matter relates to civil dispute. The alleged date of occurrence is 8.7.2011 and the FIR was instituted on 5.8.2015. No explanation in respect to the delay has been given on behalf of the prosecution.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Masaurhi P.S. Case No. 258 of 2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
