JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Buxar Town P.S. Case No. 356 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 326, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the FIR and it is alleged that he has confessed his guilt and he has got criminal history also. Submission is of false implication and that in this case FIR named accused and other co-accused, namely, Pradeep Keshari, Chandan Singh, Sriman Narain and Rajdeep Singh have been allowed bail by another co-ordinate Bench of this Court and as such the petitioner also deserves sympathetic consideration as

Patna High Court Cr.Misc. No.53952 of 2015 (3) dt.19-01-2016 against him except confessional statement and criminal antecedent there is nothing.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 356 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
