====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-09-2019 Heard learned counsel for the petitioner. No one appears on behalf of the State to oppose this application. The petitioner in the present case is seeking anticipatory bail in connection with Bheldi P.S. Case No. 68 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Excise (Amendment) Act, 2016.
Learned counsel for the petitioner submits that as per allegations, when two persons were apprehended on chase, when they were fleeing away leaving the Alto Car in which 108 liters of illicit liquor were recovered, they disclosed that the liquors were being transported for the petitioner.
Learned counsel submits that the petitioner has got no criminal antecedent and only on the basis of the alleged statements of the apprehended accused, the petitioner has been involved in this case.

No.42109 of 2019(3) dt.02-09-2019 2/2 In the given facts and circumstances of the case where the petitioner has no criminal history and the name of the petitioner has been disclosed by the apprehended accused and there is no other material to connect the petitioner prima-facie with this case, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Bheldi P. S. Case No. 68 of 2019 be enlarged on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IX-cum-Special Judge, Excise, Saran at Chapra, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e.
(i) a condition that the person shall make himself available for interrogation by a police officer as and when required; (ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) a condition that the person shall not leave India without the previous permission of the Court.
