The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 379 and other allied sections of the Indian Penal Code and sections 56(1) and 39(3) of BMMC Rules and MMDR Act and section15 of the EP Act.

35 FIR named accused persons including this petitioner are alleged to have involved in storage and transportation of illegal sand. Illegal sand about 9400 C. ft. worth Rs. 5,00,550/- stored at Maiadda jail and some loaded vehicles and JCB were recovered from the place of recovery. It is submitted that petitioner is neither owner of the said vehicle nor owner of the land where illegal sand was found

Patna High Court CR. MISC. No.36888 of 2022(2) dt.07-11-2022 2/2 stored. Petitioner has been made accused in this case only on suspicion. Similarly situated co-accused have been granted bail by the court below itself. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 315 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
