JUSTICE MUNGESHWAR SAHOO ORAL ORDER 07-04-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

Earlier the anticipatory bail was rejected on the ground that there is no allegation that the petitioner apprehends his arrest. Subsequently, warrant of arrest was issued and, therefore, this anticipatory bail application has been filed. The learned counsel for the petitioner submitted that the petitioner is Rojgar Sewak and the FIR was lodged on the basis of complaint against other Rojgar Sewak, Mukhiya, post master of the post office and other officials including private persons alleging that the amount of Manrega have been defalcated by the accused persons.

It appears that in similarly situated case, co-accused

Patna High Court Cr.Misc. No.10982 of 2016 (3) dt.07-04-2016 2/2 persons, Rajiv Kamal, Rajesh Kumar, Umesh Kumar Singh, Sabir Ahmad, Binod Kumar have already been granted anticipatory bail in various criminal Misc. applications. The copies of the orders were produced at the time of hearing of this anticipatory application. It appears that the co-accused, Rajesh Kumar has already been granted anticipatory bail. The present petitioner is also Rojgar Sewak.

In view of the above facts and circumstances of the case, I direct the petitioner to surrender before the Court below within six weeks from today and on his so surrendering, the petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Jamui in connection with Mahila P.S. Case No.57 of 2014 on condition as mentioned in Section 438 Cr.P.C.
