JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Begusarai Muffasil P.S. Case No. 370 of 2020 registered for the offence punishable under Sections 290, 120 (B) of the Indian Penal Code and Section 30(a), 41 (1) of the Bihar Prohibition and Excise Amendment Act, 2016.

It is the case of the prosecution that from a Pick-up van 774 liters of Indian made foreign liquor was recovered. From near the place of recovery, a motorcycle, which was found parked, was also seized by the Police. The petitioner is admittedly the registered owner of the said motorcycle bearing registration no. BRO9K/9095.

No.33979 of 2020(3) dt.27-01-2021 2/2 Learned counsel appearing on behalf of the petitioner has submitted that his name has surfaced on the sole basis that his motorcycle was found parked near the Pick-up van, from which huge quantity of liquor was seized. The petitioner is in custody since 24.07.2020. It is stated in paragraph 3 of the application that the petitioner has no criminal antecedent.

Considering the aforesaid submission and the fact that the petitioner is in custody since 24.07.2020, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IInd-cum-Special Judge Excise, Begusarai in Begusaria Muffasil P.S. Case No. 370 of 2020.
