JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears that name of the petitioner came in course of investigation. The learned Additional Sessions Judge referred several paragraphs of the case diary to show the materials available against the petitioner but he did not take pain to mention this fact as to what actually has come against the petitioner in the aforesaid paragraphs.

Learned counsel appearing for the petitioner submits that petitioner happens to be full sister of deceased and as a matter of fact, in referred paragraphs it has only come against the petitioner that on the alleged date of occurrence, a quarrel had

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Thakurganj (Galgaliya) P.S. Case No. 50 of 2014.
