The petitioner seeks bail in connection with Marhowrah P.S. Case No. 285 of 2014 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code. Ragani Devi, the grand-daughter of the informant was married to the petitioner on 29.05.2014 and allegedly, due to nonfulfillment of demand of Bolero vehicle, she was being tortured by the petitioner and other in-laws and ultimately they burnt her to death in the bathroom of the house.
Submission is of false implication and that in this case, other co-accused have been allowed bail and the petitioner being the husband, is suffering in custody since 22.09.2014, having no
Patna High Court Cr.Misc. No.56718 of 2015 (10) dt.18-03-2016 2/2 criminal antecedent, as a matter of fact, the wife of the petitioner committed suicide herself and due information was given to the informant by the father of the petitioner and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. seriously opposes the prayer of bail by submitting that death was caused just within four months of the marriage and all the witnesses including the villagers of the petitioner have supported the allegation regarding demand of Bolero and further that victim was crying for help. In the facts and circumstances stated above, considering the allegation attributed against the petitioner serious in nature, this Court is not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected. However, considering the detention of the petitioner, let the trial be expedited and concluded within a period of nine months.
