08-12-2015 Heard Sri Upendra Pratap Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody in Adapur (Harpur) P.S. Case No. 58 of 2014 registered for the offence under Sections 342, 302, 201, 504/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner alongwith all family members have been made accused in the present case only on suspicion. Fact remain that deceased was brother-in-law of the petitioner (husband of sister of petitioner). None had seen the occurrence and after about 20-25 days of the F.I.R., dead body was recovered.
From the order impugned, it is evident that before the
Patna High Court Cr.Misc. No.52581 of 2015 (2) dt.08-12-2015 2/2 court below, case diary was not produced, whereas, the petitioner is in custody since 07-02-2015.
In view of facts and circumstances, particularly the fact that there is no direct accusation, let the petitioner namely Pramod Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari (East Champaran)/concerned court in connection with Adapur (Harpur) P.S. Case No. 58 of 2014.
