The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 229 of 2018 registered under Sections 147, 149, 186, 353, 504, 427, 379, 307, 283 and 290 of the Indian Penal Code and Sections 5/6 of the Essential Service Maintenance Act.
The accusation is that, on receiving information about the blocking of the road due to death of one child in accident, the informant and other police personnel reached there then saw that mob of 200 people were indulged in blocking the road due to that reason, many vehicles including the ambulance were standing on the road. Patna High Court CR. MISC. No.33937 of 2019(2) dt.23-05-2019 2/2 personnel tried to pacify the matter but the mob started to abuse and dash the informant and other police personnel, in which, 18 persons named in the F.I.R. including the petitioner were identified.
Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. but no specific over act has been attributed against the petitioner and petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 229 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
