For the Petitioner/s : Mr. Malay Kumar Choudhary For the Opposite Party/s : Mr. T.N.Thakur(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.
The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 17.03.2015 passed in Cr. Misc. Case No. 46727 of 2014, on the ground that the petitioner is suffering in custody since 03.07.2014 and in near future trial is not likely to be concluded and further that medical evidence does not support the prosecution version, to which the learned A.P.P. opposes by submitting that the petitioner is the assailant. In the facts and circumstances stated above, considering that the petitioner is the assailant, I am not inclined to reconsider the prayer of bail of the petitioner and accordingly, his such prayer stands rejected.
Patna High Court Cr.Misc. No.52683 of 2015 (2) dt.18-01-2016 2/2 However, considering the detention of the petitioner, the learned trial judge is directed to expedite the trial and to conclude the same preferably within nine months, failing which the petitioner may be at liberty to renew his prayer for bail.
