2. The petitioners are named in the F.I.R. and apprehending their arrest in connection with Tilak Rai ke Hata P.S. Case No. 113 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 303(2), 352, 351(2), 74 and 3(5) of the BNS.

3. The allegation against the petitioners is to assault informant and others causing head and bodily injuries, where alleged assault was made along with co-accused persons having intention to cause death of the injured, where alleged occurrence arises out of neighborhood disputes and differences.

4. It is submitted by learned counsel appearing on behalf of the petitioners that present occurrence was free fight in

Patna High Court CR. MISC. No.39140 of 2026(2) dt.18-06-2026 2/3 nature, where both parties received injuries, therefore, it cannot be said that petitioners were under intention to cause death of the injured informant and other injured persons. It is also submitted that for the same set of occurrence petitioner's side lodged a case which has been registered as Tilak Rai ke Hata P.S. Case No. 112 of 2025. It is submitted that allegation of physical assault is appearing very much general and omnibus against petitioners, rather same is specific against Prabhav Yadav, who alleged to assault informant during the occurrence and upon medical examination injury appears grievous in nature, who is not the petitioner for the present. While concluding arguments, it is submitted that above named petitioners are men of clean antecedents.

5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie occurrence appears free fight in nature, coupled with the fact as allegation qua causing physical assault is appearing very much general and omnibus against the petitioners, accordingly both above-named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each

Patna High Court CR. MISC. No.39140 of 2026(2) dt.18-06-2026 3/3 with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Court No. 5, Buxar/concerned Court, where the case is pending in connection with Tilak Rai ke Hata P.S. Case No. 113 of 2025, subject to the conditions as laid down under Section 482(2) of BNSS.
