The petitioner seeks bail in connection with Alauli P.S. Case No.102 of 2015/G.R. No.1180 of 2015 registered under Sections 420/34 of the Indian Penal Code.
The accusation is that the petitioner and his son Rahul Kumar alias Bintu Kumar took cash of Rs.1,18,000/- from the informant on the pretext of providing the service to his son but neither the service was provided to the son of the informant nor the aforesaid money was returned to the informant by them. Learned counsel appearing on behalf of the petitioner submits that the petitioner and the informant are co-villagers and
Patna High Court Cr.Misc. No.48367 of 2015 (2) dt.09-11-2015 2/2 the petitioner has falsely been implicated in this case while he has not received any money from the informant. The petitioner having no criminal antecedent is in custody since 06.05.2015. It is further submitted that the co-accused, Rahul Kumar alias Bintu Kumar, has already been granted bail by a coordinate Bench of this Court vide order dated 19.08.2015 passed in Criminal Misc. No.32980 of 2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri T.K. Jha, Judicial Magistrate, First Class, Khagaria, in connection with Alauli P.S. Case No.102 of 2015/G.R. No.1180 of 2015.
