Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bausi P.S. Case No. 336 of 2021 lodged under Sections 25(1b)a/26 of the Arms Act. As per the prosecution case, the recovery desi pistol with 10 live cartridges alleged to be recovered from the possession of petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 27.11.2021. On point of criminal antecedent there are in total 20 cases pending against the petitioner and all belong to Excise Act. Learned counsel further submits that the petitioner is on bail in all the Excise Act

Patna High Court CR. MISC. No.37910 of 2022(2) dt.23-09-2022 2/2 cases and petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned counsel for the State opposes the prayer for bail and submits that from the antecedent it transpires that the petitioner is running syndicate.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but liberty is hereby granted to the petitioner may renew his prayer for bail after completion of 1 year of his custody or 3 months after framing of charge, whichever is earlier.
