This application has been filed under Section 439(2) of the Code of Criminal Procedure to cancel the bail of O.P.No.2, Atmanand Sharma @ Aatma Nand Sharma granted by this Court on 13.07.2017 vide Cr.Misc.No.15848 of 2017 in connection with Shahpur P.S.Case No.138 of 2016 registered under Sections 323, 406, 420, 467, 468 and 471 of the I.P.C.

The learned counsel for the petitioner submits that he is the informant of Shahpur P.S.Case No.138 of 2016. The opposite party no.2 was allowed bail under Section 438 Cr.P.C. by this Court vide Cr.Misc.No.15848 of 2017 on

Patna High Court Cr.Misc. No.46046 of 2017 (6) dt.05-09-2018 2/2 13.07.2017 giving false statement in the said petition and after release on bail he used to give threatening to the petitioner who is informant of Shahpur P.S. Case No.138 of 2016. The record shows that O.P.No.2 was allowed bail on 13.07.2017 vide Cr.Misc. No.15848 of 2017 under Section 438 Cr.P.C. after hearing the learned counsel for the petitioner who was O.P.No.2 in the said petition. I find no reason to cancel the bail granted to O.P.NO.2 vide Cr.Misc.No.15848 of 2017 on 13.07.2017 Accordingly, this application is dismissed.
