Mr. Rakesh Prabhat, learned State Counsel, in reference to the statement made in paragraph 7 of the counter affidavit submits that though the petitioner is at serial no. 1346 of the general category, the candidates upto serial no. 142 have been appointed from the general category by the District Selection Committee. He further submits that if any person junior to the petitioner has been appointed, he can raise the issue before the appropriate forum.

Since there is no representation on behalf of the petitioner and even the counter affidavit so filed after service on

Patna High Court CWJC No.2658 of 2016 (2) dt.03-01-2018 the learned counsel for the petitioner has not been contested, I deem it proper to dispose of the writ petition with a liberty to the petitioner to represent before the District Magistrate, Jamui in case any of the panelist below him has been appointed from the general category and it goes without saying that any such representation if so filed shall be considered and disposed of by the District Magistrate, Jamui in accordance with law within a period of three months of its receipt.
