The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 323, 504 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
The prosecution case is that the petitioner received money for supply of bricks to the informant, but neither bricks were supplied nor money was returned. On demand made by the informant, the accused persons abused him by calling caste name.
It is submitted by the learned counsel for the petitioner that accusation is arising of the contractual basis of the parties and on returning of the money the informant has entered into compromise. The compromise petition has been
Patna High Court Cr.Misc. No.7084 of 2016 (2) dt.17-02-2016 filed before the learned court below which has been brought on record as Annexure-4.
Considering the fact that the petitioner has retracted from his initial version, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar S.C./S.T. P.S. Case No. 25 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
