JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 This application, for grant of anticipatory bail, arises out of Complain Case No. 655 of 2016, disclosing offences under Sections 498A of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act.

Petitioner happens to be husband of the complainant and allegation against him is of subjecting the complainant to torture and cruelty due to non fulfillment of dowry demand. Submission of learned counsel for the petitioner is that entire allegation is false and concocted he was ready to keep the complainant with himself with full honour and dignity before the court below and here also, the stand of the petitioner is same.

Patna High Court CR. MISC. No.34926 of 2019(3) dt.23-08-2019 2/2 Heard learned A.P.P. also.

It appears that earlier notice was issued to complainant, brother of the wife of the petitioner, which has been received by him, however, none has appeared on behalf of the complainant.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, surrender before the court below by 06.09.2019 and the court below shall release him on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Rohtas at Sasaram, in connection with Complain Case No. 655 of 2016, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.

It is made clear that if the sister of the complainant desires to live with the petitioner, the petitioner would keep her with full honour and dignity, otherwise, the complainant will be at liberty to move for cancellation of bail bond of the petitioner. (Vinod Kumar Sinha, J) sunilkumar/- U T
