JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 353, 427/34 of the Indian Penal Code.

The prosecution case is that on 07.12.2015 in the night the informant being police officer received information that two groups are quarreling when the informant reached on the spot and tried to pacify the dispute but in the meantime, co-accused Lalan Tiwary and others put the hutment on fire as directed by other side and thereby obstructed the police in discharge of official duties.

It is submitted by learned counsel for the petitioners that the land in question was purchased by the petitioners' side in the name of the mother of petitioner No. 1 and the accusation is not specific against these petitioners.

Considering the accusation against the mob and petitioners having no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 361 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
