1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is in custody since 11.01.2024 and came to be implicated in the instant case based on the confessional statement of apprehended accused namely Ranvir Mahto. It is next submitted that Ranvir Mahto approached this court seeking regular bail by filing Cr. Misc. No.65392/2023 and the same was allowed by a learned co-ordinate Bench of this court by an order dated 13.10.2023. It is thus submitted that since Ranvir Mahto has been granted the privilege of regular bail and the
Patna High Court CR. MISC. No.44960 of 2024(2) dt.28-06-2024 2/2 name of petitioner transpired in his confessional statement, as such, the petitioner be also granted the privilege of regular bail.
4. Learned A.P.P. opposes the prayer for regular bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Amnour P.S. Case No.62/2023.
6. Further, one of the bailors of the petitioner shall be his father, namely, Mohan Singh.
7. However, it is made clear that in the event if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the case in any manner, the learned trial court shall be at liberty to forthwith cancel the bail bonds of the petitioner.
