JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-02-2016 The petitioner seeks bail in connection with Dhangai P.S. Case No.16 of 2015 registered under Sections 147, 148, 149, 307, 447 and 504 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code has been added.
It has been contended by the learned counsel for the petitioner that omnibus and general allegation has been made against five accused persons including the petitioner to have fired upon the informant of the case, but only one bullet injury was caused to the informant. It has been further contended that in course of investigation witnesses have not supported the allegation made by the informant in the FIR.
On the other hand, learned counsel for the State assisted by learned counsel for the informant has contended that similarly
Patna High Court Cr.Misc. No.52918 of 2015 (2) dt.01-02-2016 2/2 circumstanced co-accused Antu Singh, Shatrughan Singh and Pintu Singh had moved for grant of bail before this Court vide Cr. Misc. Nos.42362 of 2015, 47662 of 2015 and 50169 of 2015 respectively and a co-ordinate bench of this Court, by a reasoned order dated 5.11.2015, rejected their prayer for bail. I have heard respective counsel for the parties and perused the record.
Regard being had to the reasons assigned in the aforesaid order dated 5.11.2015 as also criminal antecedent of petitioner, I am not inclined to grant him bail. Accordingly, his prayer for bail is rejected.
