JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant. The victim in 164 Cr.P.C statement alleged that this petitioner called the victim where his friend Birendra was there who put handkerchief, as a result she became unconscious and thereafter she was taken to Maharashtra. The said Birendra proposed to marry her but somehow she managed to escape and came to Muzaffarpur. It is submitted by learned counsel for the petitioner that there are materials on record to suggest that victim was in love with Birendra. Moreover in 164 Cr.P.C statement the victim stated that she was not misbehaved by anyone.

Patna High Court Cr.Misc. No.6949 of 2016 (2) dt.16-02-2016 2/2 Considering the thrust of accusation against co-accused Birendra, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Ahiyapur P.S. Case No. 170 of 2014, pending in the Court of learned Chief Judicial Magistrate, Muzaffarpur.

With the observations above, the application stands disposed off.
