2. The petitioner is permitted to withdraw the instant criminal writ petition.

The petitioner is at liberty to take appropriate action before the learned Magistrate under Section 156(3) of the Cr.P.C. and in such event, the learned Magistrate shall act in accordance with the provisions contained in Section 156(3) of the Cr.P.C. without influenced on any part of the order passed by this Court.
