This application has been filed for quashing the order dated 30.01.2017 passed by C.J.M. cheikhpura in Sheikhpura P.S. Case no. 123 of 2016, G.R. No. 448 of 2016 taking cognizance for the offences under Sections 420, 406, 427/34 of the IPC.
Learned senior counsel for the petitioner has annexed the cheque of Rs. 4174.00 which was deposited with the authorities but the same has not been accepted by the petitioner.
This cheque was deposited in view of the order of the appellate Court under the Minimum Wages Act 1948 in
Patna High Court CR. MISC. No.13852 of 2017(4) dt.18-04-2023 2/2 Minimum Wages Appeal No. 03 of 2018.
In view of the aforesaid, keeping the criminal proceeding pending shall not serve any useful purpose. Considering the above, this application is allowed and the dated 30.01.2017 passed by C.J.M. Sheikhpura in Sheikhpura P.S. Case no. 123 of 2016, G.R. No. 448 of 2016 is hereby quashed.
