This application for grant of regular bail arises out of Kuchaikote P.S. Case No. 272 of 2020 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.
It is alleged in the F.I.R. that during the course of regular checking of vehicles by the police, one vehicle coming from the side of Uttar Pradesh, was intercepted. Occupants of the vehicle had started fleeing away, who were apprehended on chase. From the said vehicle 77.580 liters of illicit liquor was
Patna High Court CR. MISC. No.34148 of 2020(3) dt.04-01-2021 2/2 recovered. They are said to have disclosed to the police that they had purchased the liquor for illegal trade.
Learned counsel appearing on behalf of the petitioners has argued that the petitioners are in custody since 17.07.2020 and charge-sheet has already been submitted. Considering the nature of allegation and the petitioners' custody since 17.07.2020, this application is allowed.
Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II, Gopalganj in Kuchaikote P.S. Case No. 272 of 2020.
