The present application has been filed for quashing of the First Information Report of Samastipur Mufassil P.S. Case No.181/2015 registered under Sections 7 of the Essential Commodities Act, pending in the Court of learned SDJM, Samastipur.

Learned counsel for the petitioner does not dispute this fact that consequent to lodging of the FIR confiscation proceeding was also initiated vide Confiscation Case No.34/2015. Under the circumstances, this Court is not inclined to interfere at this juncture.

Accordingly the application is disposed of with

Patna High Court Cr.Misc. No.9912 of 2016 (2) dt.29-07-2016 2/2 liberty to the petitioner to challenge the order of confiscation proceeding or the final report submitted under section 173(2) of the Cr.P.C at the appropriate stage.
