The petitioner seeks bail in Siwan Mufassil P.S. Case No.407 of 2020, registered under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The petitioner is the driver of a car bearing Registration No. BR01AY-9940. On search from the car 59.31 litres of liquor was recovered.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and for recovery of 59 litres of liquor, petitioner is in jail since 08.09.2020. Taking into consideration the fact that the petitioner has already remained in jail for more than four months for
