JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1017 (C) of 2016, disclosing offences under Sections 323, 386, 504 and 506 of IPC.

Allegation against the petitioner is of demand of Rs.12,00,000/- as rangdari from the informant, who is Chairman of 'Jan Samridhi Sewa Sanshthan' registered under the Indian Societies Act.

Submission of learned counsel for the petitioners is that earlier to that a case has been lodged by the petitioner no.2 with

Patna High Court CR. MISC. No.38219 of 2019(4) dt.02-09-2019 2/2 respect to dishonour of the cheques supplied by the informant and in that he has been given legal notice to the complainant on 15.03.2019, he replied the same on 17.03.2019 and got this complaint petition filed.

Heard learned APP as well as learned counsel for the opposite party no.2-complainant, who has opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Complaint Case No. 1017 (C) of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in disposal of the complaint case.
