1. This is an application for quashing the order dated 22.11.2016 passed by the J.M., Danapur in Khagaul P.S. Case No. 44 of 2007 by which discharge petition of the petitioner has been rejected by the Court below.

2. Learned counsel for the petitioner has submitted that the police investigated the case and submitted charge sheet vide Charge sheet no. 79 of 2007 under Sections 406, 420 and 34 of the I.P.C., thereafter, on 07.08.2013, a petition under Section 239 of the Cr.P.C. was filed by the petitioner for discharging him from the allegations under Sections 406, 420 and 34 of the I.P.C.

3. Learned counsel for the opposite party has opposed the prayer of the petitioner.

4. From perusing the materials available on record, no ground for interference is made out in the impugned order by which application of the petitioner for discharge has been rejected by the court below.
