Learned counsel for the petitioner submits that for the same set of land in question, which is the subject matter of the present writ petition, title suit no. 204 of 2009 is pending for consideration before the competent Court of law. 3.

Learned counsel for the State submits that for the

Patna High Court CWJC No.19 of 2021(8) dt.09-09-2024 2/2 same cause of action, two proceedings are not maintainable and at the time of filing of the title suit, the petitioner has not added the State of Bihar as a party and after one year, he has filed an application for adding the State of Bihar as party respondent in the title suit no. 204 of 2009, which is still pending for consideration before the competent Court of law. 4.

In view of the aforesaid, the writ petition is disposed of with a direction to parties to abide with the outcome of the title suit no. 204 of 2009.

Accordingly, with the aforesaid direction, the writ petition stands disposed of.
