JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 387, 307, 302, 504, 506 of the IPC.

Prosecution case in short is that, when the informant after finishing the construction work in the evening was paying the wages of the labourers, it is alleged that all the 25 persons named in the FIR, including these petitioners, and 20 to 25 unknown persons armed with weapons came there and started to damage the newly constructed wall. It is further alleged that these petitioners snatched cash of Rs.30,000/- from the pocket of the informant.

Learned counsel appearing for the petitioner submits that there is no allegation of overt-act against these petitioners. He is only alleged to have snatched cash. Some of the similarly situated co-accused persons have already been granted bail by this court.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.48532 of 2022(2) dt.13-12-2022 2/2 prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Chandani Gupta, learned J.M. 1st class, Danapur in connection with Maner P.S. Case No. 590/2019subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
