====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 420, 406/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner along with co-accused Sri Jafar Imam misappropriated Rs.44,70,725/- of the Chandradai PACS.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Payments were made to the 37 farmers by cheque issued under the signature of co-accused Jafar Imam, the then Chairman of the said PACS and not by the petitioner. Thus the illegality has apparently been committed by said coaccused and petitioner is no way concerned with the alleged misappropriation. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 27.3.2024.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case and the period of custody of the petitioner, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Araria (RS) Police Station Case No. 14/2024.
