2. The petitioner has preferred this application for grant of regular bail in connection with Barahat P.S. Case No. 93 of 2025 dated 18.03.2025 (G.R. No. 914 of 2025) registered for the offences punishable u/ss 96, 351(2), 352 read with section 3(5) of the BNS and sections 8 and 12 of the POCSO Act.
3. As per the prosecution case, the petitioner is alleged to have kidnapped the minor daughter of the informant on the pretext of marriage.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.35851 of 2025(2) dt.18-06-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. There is lover affair between the petitioner and the victim girl. The victim in her statement recorded u/s 183 of the BNSS has stated that she has solemnized marriage with the petitioner. The victim has not raised any alarm while she was being taken to Delhi. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 19.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that as per the medical report, the age of the victim is assessed between 14 to 16 years.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Barahat P.S. Case No. 93 of 2025 dated 18.03.2025 (G.R. No. 914 of 2025), with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.35851 of 2025(2) dt.18-06-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
