2. The petitioner has preferred this application for grant of regular bail in connection with Jogbani Rail P.S. Case No. 09 of 2024 dated 24.08.2024 registered for the offences punishable under Sections 103(1) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed murder of the informant's brother under conspiracy.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.38325 of 2025(2) dt.07-07-2025 2/3 this case. The deceased along with his wife and his daughter went to Jogbani for treatment of his ill daughter. The occurrence took place on 18.08.2024 but the FIR was lodged on 24.08.2024 i.e. the delay of seven days and there is no explanation for this delay. The name of the petitioner has sprung up in this case on mere suspicion. It is further submitted that the charge-sheet has been submitted against the petitioner. The informant is not an eye-witness to the alleged occurrence. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 30.09.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the petitioner is the wife of the deceased and she committed murder of her husband in connivance with the other co-accused person, who was in love affair with the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Jogbani Rail P.S. Case No. 09 of 2024, pending in the Court of learned District & Additional Sessions Judge-II, Katihar..
