JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-12-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, Santosh Kumar, is in custody since 23.05.2015 in connection with Bath P.S. Case No.21 of 2015 under Section 379/411 of IPC. The FIR is against unknown. The co-accused, Amar Kumar, confessed before the police naming the present petitioner and except this, there is nothing against the petitioner. The motorcycle has been recovered from the house of co-accused, Raushan Kumar.

Considering the above facts and circumstances of the case, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Bath P.S. Case No.21 of 2015 on condition that one of the bailor should be relation of the petitioner.
