2. The accused/petitioner seeks bail in connection with Sachivalaya P.S. Case No.13 of 2024 registered for the offence punishable under Sections 467, 468, 471, 419 and 420 of the Indian Penal Code.
3. The accused/petitioner is named in the FIR and is in custody since 22.02.2024.
4. Allegation against the petitioner is to cheat the innocent persons by creating a forged web-site of P.M. Ayush Bharat Yojana for the purpose of cheating innocent person on the name of providing job under the project along with other unknown accused persons.

5. It is submitted by Mr. P.N. Shahi, learned senior counsel appearing for the petitioner that save and except confessional statement of petitioner as available in Para-29 of the case diary, nothing incriminating appears against him. It is submitted that even the mobile no. in issue is not connected with this petitioner and moreover the person Rishi Raj, who approached to the office of Chief Executive Officer, Patna for the purpose of joining, named specifically two persons, who are Jitendra and Ramesh. It is submitted that even the seizure list appears not supported by independent witnesses rather same are supported by Home-guard personnel. Mr.
Shahi, while concluding argument submitted that the suspicion was raised against this petitioner to create a forged web-site, where during the investigation, no electronic/scientific evidence could be collected as to connect the petitioner prima facie with crime in question. While concluding argument, it is submitted that investigation of this case has already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer for grant of bail to the petitioner.

In view of aforesaid factual submissions and by taking of fact as save and except suspicion arising out of confessional statement of petitioner, no incriminating material surfaced/recovered during the course of investigation as to connect the petitioner prima facie with allegation of cheating of innocent persons by creating a duplicate/forged web-site of P.M. Ayushman Bharat Yojana, coupled with the fact that charge-sheet has already submitted, where petitioner is in custody since 22.02.2024, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Patna in connection with Sachivalaya P.S. Case No.13 of 2024, subject to the conditions as laid down under Section 437(3) of the CrPC/under Section 480(3) of the BNSS. (Chandra Shekhar Jha, J.) Sanjeet/- U T
