This application has been filed for modification of order dated 14.10.2015, which was also modified on 13.01.2016 to extend the period of surrender of the petitioner before the Court below.
On perusal of the record, it appears that prayer of the anticipatory bail of the petitioner was rejected vide order dated 14.10.2015 passed in Criminal Miscellaneous No. 43466 of 2015 with direction to the petitioner to surrender before the trial court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
Thereafter, Criminal Miscellaneous No. 1403 of 2016 was filed by the petitioner to extend the period of surrender
Patna High Court Cr.Misc. No.18280 of 2016 (2) dt.04-05-2016 2/2 before the trial Court on the ground that petitioner could not surrender before the Trial Court due to unavoidable circumstances and further the said application was allowed on 13.01.2016 extending the period of surrender for four weeks from the passing of the said order.
Having considered the facts and circumstances of the case, I am not inclined to reconsider the prayer for extension of time to surrender before the trial court of the petitioner. Accordingly, the prayer of the petitioner is rejected. (Rajendra Kumar Mishra, J) manish/- U T
