The petitioner is in custody in connection with Special Case No. 11070 of 2019, arising out of Khajekalan P.S. Case No.524 of 2019, for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. In the instant case, total 520 lietres of country made liquor was seized.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was not named in the first information report and his name surfaced at subsequent stage. Learned counsel submits that since the petitioner is the owner of Scooty, he has been made accused in this case.

No.34844 of 2020(2) dt.25-01-2021 2/2 Considering the period of custody of the petitioner, the Court is inclined to grant to the petitioner subject to the condition that the petitioner has to deposit Rs.50,000/- in cash. On depositing the amount of Rs.50,000/-, petitioner, abovenamed shall be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Patna in connection with Special Case No.11070 of 2019, arising out of Khajekalan P.S. Case No.524 of 2019. Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of Special Case No.11070 of 2019, arising out of Khajekalan P.S. Case No.524 of 2019.
