JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364, 302 and 201/34 of the Indian Penal Code.

The prosecution case is of kidnapping the informant and subsequently killing him. The suspicion was raised against the petitioner that since the victim was in love affair with one Sindhu Kumari and the petitioner happens to be maternal uncle of said Sindhu Kumari.

Learned counsel for the State submits that statement of the witness Mogal has bee recorded in paragraph no.37 of the case diary where he has confessed that that the victim was killed in the house of this petitioner.

Considering the nature of accusation, let the learned
