JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 341, 323, 366(A), 376/34 of the Indian Penal Code.

The prosecution case is that the informant was abducted by co-accused Raja Thakur on the pretext of marrying with her, who ravished her and thereafter married with her. Subsequently, co-accused, Uday Choudhary, took the informant to his house at village Dumaria where petitioner and Uday Choudhary ravished her in spite of protest being made.

It is submitted by the learned counsel for the petitioner that the thrust of accusation is against co-accused Raja Thakur, who performed marriage with informant and petitioner

Patna High Court Cr.Misc. No.7180 of 2016 (2) dt.17-02-2016 2/2 has been simply roped in this case because he is related to coaccused, Uday Choudhary, who is brother-in-law of Raja Thakur. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Kadwa P.S case No. 174 of 2015 pending in the court of learned A.C.J.M., 1st Katihar.

This application is disposed of with the aforesaid observation/direction.
