====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 31-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with S.T. No. 233 of 2024 arising out of Sour Bazar (Patarghat O.P.) P.S. Case No. 151 of 2024, registered for the offence punishable under Section 302 of the Indian Penal Code.

3. Earlier, the prayer for bail of the petitioner was rejected vide order dated 23.10.2024 in Cr. Misc. No. 74600 of 2024. The petitioner is accused of hitting the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 21.02.2024. From the report of the learned trial Judge, it appears that only one witness has been examined in the trial out of seven witnesses.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the delay in trial and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Saharsa / concerned Court below in connection with S.T. No. 233 of 2024 arising out of Sour Bazar (Patarghat O.P.) P.S. Case No. 151 of 2024, subject to the following condition:

As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his counsel on each and every date fixed by the trial court. Non-compliance of this condition shall result in cancellation of the bail bonds of the petitioner.
