The petitioner is in custody in connection with Case No. C-2/186 of 2019, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case total 27.900 liters of Nepali Saufi wine was recovered. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 09.04.2019. Considering the facts that petitioner has no criminal antecedent and he has remained in custody for more than 1 1⁄2
